President Obama has not been successful with his legislative agenda in the 112th Congress. So, like the sore loser on the playground, he changes the rules of the game.
If the president doesn’t get his way through the democratic process, he issues executive orders or directs government agencies to issue new rules.
In President Obama’s case, this is deliberate circumvention of Congress and the will of the people.
Congress failed to pass the so-called Cap and Trade legislation, so the president ordered the EPA to formulate and institute new draconian regulations limiting release of carbon dioxide that will increase energy costs and kill jobs.
The president failed to win passage of the DREAM Act, so he issued orders to the Department of Justice and the Department of Immigration and Customs Enforcement to implement key provisions of the failed legislation. In essence, amnesty for illegal aliens by presidential order.
Card Check, the legislation which would ban secret ballots in union organizing elections, failed to make it through Congress, even when the Democratic Party controlled it. To make certain he repaid organized labor for its support, the president packed the supposedly neutral National Labor Relations Board (NLRB) with union hacks, who in turn have proposed rules to implement the failed card check legislation.
There are, however, remedies, if Congress has the courage and the will to use them.
The Congressional Review Act (Public Law PL 104-121) allows Congress to review EVERY regulation and, through a joint resolution, overrule them. The law, passed in 1996 as part of the Small Business Regulatory Enforcement Fairness Act of 1996, spells out the review and override procedures.
As with any bill, the president has veto power, but Congress can override his veto. For the text of the CRA go here: http://usgovinfo.about.com/library/bills/blcra.htm.
Executive orders pose a different challenge.
Congress cannot simply vote to override an executive order. They can, however, draft and pass legislation cancelling or changing the order. Legislation to override an executive order is subject to the same rules, including veto and veto override, as any other bill.
Conservatives control the House of Representatives, but need the help of “moderate” Democrats and Independents to move bills through the Senate. With strong leadership and a dogged adherence to principles, conservatives can prevail and defeat the president’s programs, again.
This is why it is imperative that conservatives maintain control of the House and take control of the Senate in 2012. Couple this with a Republican president, and we can begin to reverse the damage done by America’s first socialist president and his Democratic mob.
However, we cannot sit idly by and let Obama and his mob wreak further havoc on the country. We must keep constant pressure on our elected representatives to stand firm on their principles and work to defund and defeat the president’s nefarious programs.
To borrow the New Hampshire state motto, we must “Live free, or die.” In order to live free, we must defeat the programs and policies of Obama and his mob now, or the country may die.
